General

This Privacy Statement applies to Five Star Wellbeing (referred to as "we", "us" or "our" in this Privacy Statement) in the course of our business in Canada. This Privacy Statement is designed to inform individuals with whom we may interact in the course of our business in Canada, including individuals who purchase our products or services, (referred to as "you" or "your" in this Privacy Statement) about our practices regarding collection, use and disclosure of your personal information, including information you provide over the telephone, by mail, email or facsimile and via our commercial Web Site(s). This Privacy Statement applies to the Web Sites that Five Star Wellbeing maintains which post or include a link to this Privacy Statement (the "Web Sites"). This Privacy Statement does not apply to personal information about our employees or information that is not personal information.


What personal information will Five Star Wellbeing collect?

Five Star Wellbeing collects personal information from you that you provide to us voluntarily. Such personal information may include: personal contact information, such as name, professional qualifications, e-mail address, street address, and telephone number; your personally identifiable comments and questions about our products and services; and information required to order our products and services (including credit card information).

Five Star Wellbeing accepts credit card payments through our Jane App. Credit card information is not accepted via postal/mail, facsimile, or email.

Information collected through our website is analyzed with the purpose of better understanding our customers' needs and targeting our marketing strategies to satisfy those needs. Through the use of "cookies", we are able to measure site traffic, including the number of repeat versus new visitors, the time users spend online, and their navigation behavior. Collecting this information allows us to make changes that improve the overall functionality of the site.

In some cases, we may collect information about you that is not personal information. Examples of this type of information include the type of Internet Browser you are using, the type of computer operating system you are using and the domain name of the web site from which you linked to our Web Sites. If that material is not linked to other information that is "personal information" about you, the non–personal information is not subject to this Privacy Policy.

If we obtain personal information from third parties, for example to send promotional mailings, we seek assurances that the provider has received consent to provide that information to us.

In addition, please remember that any personal information that is voluntarily posted to any public area of the Web Sites – such as a chat room – may always be accessible to other visitors and that there is nothing Five Star Wellbeing can do to prevent collection, use or disclosure of this information by those visitors.


How will Five Star Wellbeing use and disclose the personal information we collect?

We use and disclose this personal information for the following purposes:

(a) to fulfill your orders, to process payments (including by credit card on the phone or by ordering online) and to collect amounts you owe;

(b) to respond to your requests for information and service and to communicate with you;

(c) to carry out internal financial processes including to credit our sales representatives;

We sometimes transfer personal information to others, including to affiliated entities or unrelated companies ("service providers"), that carry out certain functions on our behalf such as order fulfillment, accounts receivable and data processing. In those cases we require those service providers not to use or disclose your personal information for any purpose other than as directed by Five Star Wellbeing. Some of these service providers may be located outside of Canada, including in the United States, the United Kingdom and India, and your personal information may be collected, used, disclosed, stored and processed in those jurisdictions for the purposes described in this Privacy Statement. We take reasonable contractual or other measures to protect your personal information while processed or handled by these service providers. If your personal information is located outside Canada it will be subject to legal requirements in those foreign countries applicable to our service providers, for example, lawful requirements to disclose personal information to government authorities in those countries.

Your personal information may be used by Five Star Wellbeing and shared with others connected with the contemplated or actual financing, insuring, sale, assignment or other disposal of all or part of Five Star Wellbeing business or assets, including for the purposes of permitting such parties to determine whether to proceed with such transaction or business relationship, or to fulfill any disclosure obligations we have to such parties. If we do sell or assign all or part of our business, the purchaser or assignee will be able to use and disclose personal information to the same extent, under the same conditions and for substantially the same purposes as Five Star Wellbeing, as described in this Privacy Statement.


Your consent

Consent can be express (express consent may be oral, in writing or electronic), implied (such as when you provide your name and address in order for us to send you products you have ordered or information you have requested) and in some jurisdictions may be given by your authorized representative (such as a legal guardian or a person having a power of attorney). Authorized employees, agents and mandataries of Five Star Wellbeing who require the personal information to fulfill the purpose for which the information was collected will be permitted to access personal information. Although we have enacted security measures for our Web Sites, we cannot guarantee the absolute security of our Web Sites or the security of information that you submit (or that we send to you) over the Internet, since no Internet transmission is ever 100% secure or error–free.
